Terms of Service

Welcome to Cipheus! These Terms of Service ("Terms") govern your use of the Cipheus mobile application ("App"), the Cipheus website (cipheus.com), and all related services (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading, or using Cipheus, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Services.

2. Eligibility

You must be at least 13 years old to use Cipheus. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. Account Registration

To use Cipheus, you must create an account using Apple Sign-In or Google Sign-In. You are responsible for:

• Providing accurate and complete profile information
• Maintaining the security of your account and device
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that are inactive for an extended period or that violate these Terms.

4. Acceptable Use

You agree to use Cipheus responsibly and lawfully. You must not:

• Violate any applicable laws, regulations, or third-party rights
• Harass, bully, threaten, or abuse other users
• Send spam, unsolicited messages, or malicious content
• Impersonate another person or misrepresent your identity
• Share content that is illegal, hateful, violent, sexually explicit, or harmful to minors
• Attempt to access other users' accounts without authorization
• Interfere with, disrupt, or overload the App's systems or infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the cipher transformation to circumvent content moderation or hide prohibited content
• Create multiple accounts for abusive purposes or to evade a ban

5. Content & Language Packs

You retain ownership of the content you create, including messages and custom language packs. By using the Services, you grant us a limited license to store, transmit, and display your content as necessary to operate the Services.

Custom language packs you create are tied to your account. If you delete your account, your custom language packs will also be removed. Preset language packs provided by Cipheus remain our intellectual property.

Messages posted to the Secret Wall on our website are anonymous and public. By publishing to the Secret Wall, you grant us a perpetual license to display that content.

6. Blocking & Reporting

You can block other users to prevent them from contacting you. You can also report users for violations including spam, harassment, hate speech, violence, inappropriate content, fraud, or impersonation. We review reports and may take action including warnings, temporary suspensions, or permanent account termination. Misuse of the reporting system (e.g., filing false reports) may itself result in account action.

7. Privacy

Your use of Cipheus is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review the Privacy Policy carefully.

8. Chat Backup & Data Export

Cipheus provides a local chat backup feature that allows you to export your chat history as an encrypted file. By using this feature, you acknowledge and agree that:

• You are solely responsible for storing your backup file and remembering the export password
• We cannot recover or reset a forgotten backup password. If you lose the password, the backup cannot be restored
• Backup files are encrypted on your device and never pass through our servers
• You are responsible for the security of your exported backup files once they leave the App
• We are not liable for any data loss resulting from forgotten passwords, corrupted files, or lost backup files

9. Subscriptions & Purchases

Cipheus offers an optional premium subscription ("Cipheus+") with additional features. By subscribing, you agree that:

• Subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions
• New users receive a free trial period. After the trial, your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel your subscription at any time through your Apple ID settings
• When your subscription ends, premium features will be restricted and you will revert to the free tier. Your content (including frozen custom language packs) will not be deleted
• Free trial extensions earned through the referral program are subject to our anti-abuse policies and may be revoked if obtained through fraudulent means
• We reserve the right to modify pricing, features, or trial terms at any time. Changes will not affect active subscription periods

Intellectual Property

Cipheus and its original content, features, functionality, branding, cipher systems, language pack designs, and website are owned by us and protected by international copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content
• Use the Cipheus name, logo, or branding without written permission
• Create derivative works based on the App or its cipher systems
• Commercially exploit the preset language pack symbols outside of the App

10. Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in prohibited conduct, or for any other reason at our reasonable discretion. Upon termination, your right to use the Services will immediately cease. You may also delete your account at any time through Settings in the App. Account deletion is permanent and cannot be undone.

11. Disclaimers

Cipheus is provided "as is" and "as available" without warranties of any kind, whether express or implied. Specifically:

• We do not guarantee uninterrupted, error-free, or secure operation of the App
• We do not guarantee that messages will be delivered immediately or at all
• While messages are protected with end-to-end encryption, the cipher visual transformation is an additional visual experience feature that displays messages as symbolic characters
• We are not responsible for content created or shared by users

12. Limitation of Liability

To the maximum extent permitted by applicable law, Cipheus and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, resulting from your use of or inability to use the Services.

13. Indemnification

You agree to indemnify and hold harmless Cipheus and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by posting on our website. Your continued use of Cipheus after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you should stop using the Services.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of the applicable jurisdiction.
